Your acceptance

These Terms of Use (“Terms”) apply to your use of the EVOX application, websites, products and services. These Terms represent an agreement between E2 Nova Corp., a United States corporation (“E2 Nova"), the owner and operator of EVOX calling services and EVOX App (collectively, including all content provided by EVOX, the "EVOX Service", or the "Service"), and you (“you” or “You”), a user of the Service. Please read these Terms carefully; by using EVOX, you agree to be bound by the Terms.

EVOX Service

Subject to your compliance with these Terms of Use, E2 Nova hereby grants you permission to use the Service, provided that: (i) your use of the Service as permitted is solely for your personal use, and you are not permitted to resell or charge others for use of or access to the Service, or in any other manner inconsistent with these Terms of Use; (ii) you will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without E2 Nova’s prior written authorization; (iii) you will not attempt to reverse engineer, alter or modify any part of the Service; and (iv) you will otherwise comply with the terms and conditions of these Terms of Use and Privacy Policy. Unauthorized use of any of E2 Nova’s trademarks, logos, domain names or other distinctive brand features is prohibited.

You promise to use the service only for lawful purposes, and to not violate the rights of third parties. Any unacceptable use, including making phone calls that are fraudulent, obscene, pornographic, gory, illegal, threatening or harassing, excessively violent or promoting the harm of self or others, may result in immediate termination of your account and suspension of service access in the future.

Intellectual Property Rights

The design of the EVOX Service along with E2 Nova created text, scripts, graphics, interactive features and the like, and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to E2 Nova, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. The Service is provided to you AS IS for your information and personal use only. E2 Nova reserves all rights not expressly granted in and to the Service. You agree to not engage in the use, copying, or distribution of any of the Service other than expressly permitted herein, including any use, copying, or distribution of Status Submissions of third parties obtained through the Service for any commercial purposes.

Account

You agree to provide real, true, accurate and complete information when you register as a user of the Service, and will frequently modify the information to keep it update to date. You are fully responsible for keeping your registration password safely and confidentially from being stolen or copies. E2 Nova has the right to terminate those accounts being used illegally or improperly, including those not active for more than 1 year. Terminated accounts are not recoverable.

Privacy

Our Privacy Policy explains our collection and use of information on the service, including information you may consider personal. You consent to the information practices described in that policy as it may be updated from time to time.

Security

We take the security of users very seriously. We use reasonable practices to protect the security of your account and data associated with it, but we can’t guarantee that someone won’t be able to defeat our security measures. Please let us know immediately if you discover any compromise of your account. We are always on the lookout for security loopholes in EVOX. If you discover a vulnerability in our service, we would be grateful for your report and encourage you to let us know immediately. To report a vulnerability, please email support@d2nova.com .

Changes to our service

EVOX is a dynamic product, always evolving and (hopefully) getting better. As a result, we may change, eliminate or restrict access to our products or any part of our service at any time, for any reason, with or without advance notice. And we may do so with respect to one, some or all of our users.

Disclaimers

EVOX is provided “as is” without any warranties, express or implied. E2 Nova disclaims all warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.

Limitation of Liability

To the fullest extent allowed by law, E2 Nova shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses resulting from (A) your access to, use of, inability to access or inability to use EVOX; (B) any third party conduct or content on EVOX, including any defamatory, offensive or illegal conduct of third parties; or (C) any unauthorized access, use or alteration of your content.

Arbitration

If you become disgruntled with EVOX for any reason, we’d like the opportunity to work out our differences informally. We strongly encourage you to contact us at support@d2nova.com and we’ll do our best to resolve the dispute in good faith.

Governing law and jurisdiction

These Terms will be governed by the laws of the State of California, except for its conflict of laws principles.

Modification

These Terms may be modified from time to time. The date of the most recent revisions will always be at https://www.evoxglobal.com/tw/privacy-policy. If we make changes that we believe will substantially alter your rights, we will notify you by posting a notice on our website. You agree to accept any changes or revisions to these Terms by continuing to use EVOX.
